Founders usually assume trademark registration takes a few weeks. The reality is measured in months, sometimes longer if there are objections or oppositions. Understanding the real timeline is essential — filing too late (right before launch) is one of the most common and expensive mistakes we see.

EU trademark (EUIPO) — typical timeline

  • Filing → formalities check: 1–2 weeks
  • Examination: 2–3 weeks
  • Publication for opposition: 3 months (a mandatory window for third parties to object)
  • Registration certificate: 4–6 months from filing (if no oppositions)

US trademark (USPTO) — typical timeline

  • Filing → assignment to examining attorney: 5–8 months (as of 2026)
  • First office action or approval: within 1–2 months after examination begins
  • Publication for opposition: 30 days
  • Registration certificate: typically 10–14 months from filing

The USPTO backlog has grown significantly since 2022. Filing early is more important than ever if a US launch is on your roadmap.

Madrid Protocol (WIPO) — international timeline

WIPO issues the International Registration within about 2–4 months. Each designated country then has 12 or 18 months to examine and either grant protection or issue a refusal. Total time to full protection everywhere: 6–18 months, depending on which countries you selected.

What can slow things down

  • Office actions from the examiner (unclear specification, likelihood of confusion, descriptiveness)
  • Oppositions filed by third parties during the publication window
  • Backlogs at the trademark office (currently significant at the USPTO)
  • Requests for translation, legalisation or proof of use in certain designated countries

When to file relative to your launch

The correct answer is: as early as possible, ideally 6–12 months before launch. Most jurisdictions — including the EU, China, Japan and most of Latin America — operate on a strict first-to-file basis. Whoever files first wins, even if you were using the name first. If you launch a brand publicly before filing, you risk seeing someone else register it and forcing you to rebrand — a five- or six-figure mistake.
