Intellectual property is any creation of the mind that the law recognises as owned. Most successful businesses rely on a combination of four main categories of IP, each with a different scope, cost profile and enforcement mechanism. Understanding which applies to which part of your business is the starting point of any IP strategy.

1. Trademarks

Trademarks protect brand identifiers — names, logos, slogans and, in some jurisdictions, colours, sounds and packaging — that distinguish your goods or services from those of competitors. Registration gives you exclusive rights in your industry and territory, and the legal footing to stop imitators. Trademarks can be renewed indefinitely as long as they are used.

2. Patents

Patents protect new inventions and technical processes that are novel, inventive and industrially applicable. In exchange for public disclosure, the patent holder gets up to twenty years of exclusive rights. Patents are the strongest form of IP for genuinely new technology — and also the most expensive to obtain and defend.

3. Copyright

Copyright protects original creative works — text, images, music, software, video, architectural drawings and more. It arises automatically on creation in most countries, but voluntary registration and clear ownership documentation make enforcement far easier. Copyright typically lasts for the life of the author plus decades.

4. Trade secrets

Trade secrets protect confidential business information that gives you a competitive edge — provided you take reasonable steps to keep it secret. There is no registration; protection lasts as long as the information stays confidential. The classic example is a beverage formula that has remained a trade secret for over a century.

How they work together

Most companies rely on more than one type of IP. A software product might combine copyright in the code, patents on core algorithms, trademarks on the product name and trade secrets on the training data. A hotel brand might combine trademarks on the name, copyright on marketing materials and trade secrets on operational playbooks. A well-planned portfolio uses each right where it is strongest.
